These Terms form a binding agreement between you and Develop Together LLC d/b/a Rubrico ("Rubrico," "we," "our," "us") for your use of https://rubrico.io and related services (the "Service"). This is not legal advice.
1. Who we are
Rubrico is an alignment coaching platform that helps learners assess how well their drafts align to rubric criteria and receive learning-oriented guidance to improve their own work. Rubrico is owned by Develop Together LLC, 30 N. Gould St. Ste R, Sheridan, WY 82801. Rubrico does not create, sell, or provide work for submission, and does not authorize or encourage misconduct of any kind.
2. Acceptance of these Terms
By accessing the Service, creating an account, or clicking to accept, you agree to these Terms, our Privacy Notice, and any feature-specific terms. If you use the Service for an organization, you represent you have authority to bind that organization.
3. Changes to these Terms
We may update these Terms. We will revise the "Last updated" date and may provide additional notice. Continued use means you accept the updates.
4. Eligibility and age
- Consumer use is for individuals 13+ in the United States.
- If you are under 13, do not use the Service unless your school has enabled it as a school-provided tool and obtained any COPPA consent.
- If you are 13–17, you confirm you have parent/guardian or school consent.
- For institution-provided use, Rubrico may act as a school official with a legitimate educational interest under FERPA.
5. What Rubrico does—and does not do
Rubrico provides: rubric-alignment analysis; coaching and feedback on structure and criteria coverage; planning aids; and references to general learning resources. Rubrico does not provide: third-party authorship, ghostwork, work you may submit as your own, grade or admission guarantees, or any authorization to bypass course or integrity rules. You are responsible for your submissions, citations, sources, and compliance with your institution or organization.
6. Honor Code and acceptable use
Our Honor Code is simple: we coach, you create, your work remains your own. You agree not to use the Service to:
- obtain or submit work you are not authorized to represent as your own;
- misrepresent authorship or sources, or evade assignment requirements;
- infringe others' rights or laws (including export/sanctions);
- reverse engineer, disrupt, or misuse the Service or APIs;
- harass, spam, deploy malware, or overload the Service.
We may suspend or terminate access for suspected violations, safety risks, fraud, or legal compliance.
7. Accounts and security
Provide accurate info, keep credentials secure, and notify us of unauthorized use. You are responsible for activity under your account. We may refuse usernames that impersonate others or violate rights. You may verify and access your account via one-time passcodes (OTP) sent to your email address; keep your email secure and up to date.
8. Third-party services
We may integrate third-party services for hosting, secure portals, billing, analytics, messaging, and similar functions. Their terms and privacy notices may apply to those components. You authorize our service providers to process data as needed to operate those features.
9. Pricing, subscriptions, auto‑renewals
- Pricing & Fees: shown at checkout; taxes may apply. Public site reflects that pricing starts at $15/hour for timelines 24+ hours, charges are time‑based.
- Fees are non-refundable unless required by law or expressly stated; contact support if we materially fail to deliver a paid feature.
- We aim to comply with ROSCA and state ARL laws (e.g., CA). We provide clear renewal terms, post-purchase acknowledgment, an easy online cancellation path, and renewal notices where required.
- You authorize Rubrico and its payment processors to charge your payment method for subscriptions, renewals, and usage‑based fees.
10. Your content; license; de‑identification
You retain ownership of drafts, rubrics, notes, and uploads ("User Content"). You grant Rubrico a non-exclusive, worldwide, royalty‑free license to host, process, analyze, transmit, and display User Content to provide, maintain, secure, and improve the Service. We may create and use de‑identified or aggregate data for analytics, safety, and product improvement and will not attempt to re‑identify it. You confirm you have rights to upload and use your User Content.
11. AI-assisted features and human review
The Service may use automated or AI‑assisted analysis. Outputs can contain errors or gaps and depend on your inputs. You agree to verify facts and rubric interpretations, use outputs as learning aids, and follow applicable rules on AI tools. Model training options. Where applicable, we may use de‑identified interaction data to improve models and safety systems and will obtain consent or provide an opt‑out.
12. Privacy and data protection
See our Privacy Notice for categories of data, purposes, retention, sharing, analytics, and state privacy rights (e.g., CCPA/CPRA, CO, CT, UT, VA).
- For consumer use, Rubrico generally acts as an independent controller (or equivalent).
- For institution-provided use, Rubrico may act as a processor/school official under FERPA.
- We honor applicable DSRs (access, deletion, correction, portability, opt‑out of targeted ads/sale where defined by law).
- We do not sell personal or student data as "sale" is defined by CPRA and similar laws.
- Cross‑border transfers use legally recognized mechanisms.
13. Security and incident response
We implement administrative, technical, and physical safeguards appropriate to the data we process. No system is perfect. If a breach requiring notice occurs, we will notify affected parties in accordance with law.
14. Accessibility
We aim for WCAG 2.2 AA‑aligned experiences where feasible. Request accommodations via the contact in §32.
15. Community safety and moderation
We may review, limit, or remove content or accounts that violate these Terms or present safety or legal risks. We are not required to pre‑screen but may do so.
16. Intellectual property
The Service (software, models, interfaces, designs, trademarks, templates) is owned by Rubrico and its licensors. Except as expressly granted, no rights are transferred. Do not copy, modify, distribute, or reverse engineer except as allowed by law.
17. Feedback
If you send suggestions, you grant Rubrico a perpetual, irrevocable, worldwide, royalty‑free license to use and commercialize them without obligation.
18. Beta and experimental features
Beta or preview features are provided "as is," may be unstable, and can be changed or discontinued.
19. Availability and changes
We may change, suspend, or discontinue features. Outages or maintenance may occur. We are not liable for interruptions beyond our reasonable control.
20. External links and resources
Links to third‑party sites are provided for convenience. We do not control third‑party content or policies.
21. Compliance; export and sanctions
Do not use the Service in violation of U.S. export or sanctions laws or if you are on a prohibited list or in an embargoed jurisdiction.
22. Communications and consent (Email & SMS/Voice)
You consent to receive transactional communications (e.g., receipts, security alerts, OTP codes for login/verification) via email and/or SMS/voice.
- OTP & transactional: We may send one‑time passcodes and important account or order updates. Message & data rates may apply.
- Promotional texts/emails: With your consent, we may send promotional texts and emails about offers, product updates, and announcements. Consent is not a condition of purchase. You can opt out at any time (e.g., reply STOP to SMS; use unsubscribe links in email; or change settings in your account).
- Help & support: For SMS help, reply HELP. Message frequency varies.
23. Institution‑specific terms (if applicable)
If you are an educator/admin/institution: you are responsible for policy compliance; you will provide required notices; you represent you have rights to share rubrics and content; and we will execute a DPA/FERPA addendum on request consistent with our standard forms.
24. Payment processing; chargebacks; fraud
Payments are processed by Rubrico and its processors. You authorize recurring charges for subscriptions until you cancel. We may limit access for failed payments or suspected fraud. Contact support before disputing a charge.
25. Refunds; statutory rights
Except where required by law or expressly stated, fees are non‑refundable. We honor any applicable cooling‑off or statutory refund rights.
26. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT GUARANTEE SPECIFIC GRADES, ADMISSIONS, OR OUTCOMES.
27. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUBRICO AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUE/DATA; OR REPLACEMENT COSTS. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE EVENT OR (B) US $100. Consumer carve‑outs apply as required by law.
28. Indemnification
You agree to defend and indemnify Rubrico and its affiliates against claims arising from your misuse of the Service, your User Content, or your violations of law or these Terms.
29. Suspension and termination
We may suspend or terminate access for any reason, including violations, non‑payment, or safety/legal risks. Certain sections survive termination.
30. Dispute resolution; arbitration; class‑action waiver
Except for small‑claims matters, disputes will be resolved by binding individual arbitration under the provider's consumer rules. No class actions. You may opt out within 30 days of account creation by mailing a signed notice to the address in §32. Either party may seek temporary injunctive relief in court. This section is governed by the Federal Arbitration Act.
31. Governing law; venue
These Terms are governed by Delaware law (without conflict rules), subject to non‑waivable consumer protections in your state. Courts in Delaware have exclusive jurisdiction for disputes not subject to arbitration.

33. Assignment
You may not assign these Terms without our consent. We may assign in connection with a merger, acquisition, or corporate reorganization.
34. Severability; waiver
If a provision is unenforceable, it will be enforced to the maximum extent permitted; the remainder stays in effect. Our failure to enforce is not a waiver.
35. Entire agreement
These Terms, the Privacy Notice, plan details, and any feature‑specific terms constitute the entire agreement and supersede prior agreements on the Service.
36. State‑specific terms (summary)
- California (ARL/CPRA): We provide clear auto‑renewal terms, post‑purchase acknowledgment, and an easy online cancellation path; CPRA rights are described in our Privacy Notice.
- Colorado, Connecticut, Utah, Virginia (and others): Residents have rights described in our Privacy Notice (access, delete, correct, portability, targeted‑ads/sale opt‑out where applicable).
- New Jersey: Limitations of liability/disclaimers apply only to the extent permitted by NJ law. If state law grants greater protection, that law controls.
37. Educational addendum (institutions)
If provisioned via an institution under a separate agreement:
- Rubrico acts as a school official with a legitimate educational interest; education records are used only to serve the institution.
- DPA & sub‑processors: We will execute a DPA and provide a sub‑processor list and advance notice of material changes where required.
- Education records are retained only as needed to provide services, comply with law, or as the agreement specifies, then deleted or de‑identified.
- We maintain an information security program with access controls, encryption in transit, and vulnerability management.
- Incident response: We will notify the institution without undue delay of any breach involving education records and cooperate as required.
38. Independence from institutions
References to universities or colleges on the site are for descriptive purposes only to indicate where learners study. Rubrico is independent and not affiliated with those institutions, unless expressly stated.
5. App Permissions (mobile)
5.1 Notification Permission
Purpose: We request permission to send push notifications related to order updates, account activity, and promotional offers.
User Control: You can enable or disable notifications through your device settings or within the App settings. Disabling notifications will not impact core App functionality but may prevent you from receiving important updates.
5.2 Files Permission (Storage Access)
Purpose: This permission allows the App to access and manage files stored on your device. It is used for uploading or downloading documents related to your orders and storing app‑related files for offline access and improved performance.
User Control: You can revoke this permission through your device settings. Restricting this permission may prevent you from uploading required files.
User Consent & Control Over Permissions
We only request permissions when necessary to provide essential features. You can manage or revoke permissions at any time through your device settings. We do not access or use these permissions for any purpose beyond those explicitly stated.
